Why is that?</b></p><p>John Monocello: The type of work we do does not require us to be in a downtown highrise or what you would typically think of as an office for a law firm. We don’t do litigation. We don't go into court. We’re very much a patent strategy firm and work on transactions.</p><p>Long before the pandemic, we had people based all over the country. </p><p>When you’re not limited by geography and requiring people to come into an office, you can attract excellent talent. You can be a little bit more flexible in this model and meet people where they are as far as childcare responsibilities, work-life balance, etc. In doing so, you get access to talent that might otherwise be disengaged from the workforce. </p><p><br /></p><p><b>PB: How has your firm leveraged technology to facilitate remote work?</b></p><p>JM: In a remote work environment, you have to be available because you can't just pop by someone’s desk or bump into each other at the watercooler. So, our culture leans toward overcommunication. We are very, very communicative – calling each other, instant messaging on Microsoft Teams, that sort of thing. </p><p>We use various tools to collaborate around workflows and projects because email is just not very satisfying to work with. For example, we manage our approval processes using tools on the Office 365 platform.</p><p>We always have email running in the background for more formal communications, but we have a culture of very frequent communication across multiple channels. </p><p><br /></p><p><b>PB: GTC ranked second among firms with 50+ patents issued in our <a href="https://blog.patentbots.com/2023/04/2023-patent-quality-rankings-top-50.html" target="_blank">2023 Patent Quality Rankings</a>. How has your firm developed a culture of quality? </b></p><p>JM: Good patent work requires excellent checklists and processes that you develop and hone over years of practice. </p><p>Inside of those checklists and processes are the tools you use to maintain quality and consistency. It’s a methodology. </p><p>Everyone on our team uses the same technologies and everyone is trained and versed in the checklist and the expectations. At a very early age, I was involved in scouting fields and reviewing test plots. Farmers and those in agriculture are incredibly innovative and meticulous. With so much uncertainty (weather, markets, etc.), they work hard to identify varieties, chemistries, and technologies that perform best within their operation.</p><p>Later, in my biotechnology graduate program at Texas A&M University, I got my first "taste" of intellectual property through the research and development of a mobile plant pathology diagnostic technology. At the conclusion of my internship, I participated in a strategic meeting between the scientists (me!) and legal and business development professionals. </p><p>I was starstruck. I credit that meeting as a pivotal moment in my career. As I walked back to my office, I committed myself to being in more rooms like that and to understanding science, business, and the law. </p><p><br /></p><p><b>PB: What female role models influenced your development as a professional?</b></p><p>BV: I was born into a family of strong, independent, smart, and savvy women. Although not professionally trained in science or law, my mom, grandmas, and aunts were tremendous early influences in my professional development.</p><p>Beyond family, I’ve had a variety of dynamic academic and professional opportunities that included smart, compassionate, driven, innovative, and self-aware female role models. These women have influenced the way I show up in my day to day and how I strategically formulate and execute on my goals.</p><p><br /></p><p><b>PB: What legal tech do you use in your own practice?</b></p><p>BV: Legal technology is an amazing asset necessary to do our best work and provide our clients with excellence. As a patent scientist, I’ve used legal technology to assist with case management, billing/time tracking, document management and automation, examiner statistics, and proofreading. </p><p>I’m excited to continue to implement new legal technologies throughout my practice. It seems like something new emerges every day!</p><p><br /></p><p><b>PB: On LinkedIn, you shared that you were interested in the intersection of AI and IP law. What are you expecting in 2023?</b></p><p>BV: As machine learning engineer Santiago L. Valdarrama said: "AI will not replace you, a person using AI will." </p><p>The use of AI in intellectual property will only continue to grow. That raises questions like … </p><p></p><ul style="text-align: left;"><li>How can we use AI to serve our clients and communities better as IP professionals?</li><li>What duty do we have to learn and implement AI tools into our practices?</li><li>How will we overcome the challenges that come with patenting AI?</li><li>How will we cite the support of AI in both inventorship and authorship? </li></ul><p></p><p>I think the discussion around these questions will continue to evolve throughout 2023 and beyond! </p><p><br /></p><p><b>PB: What is one thing you would change about the IP industry?</b></p><p>BV: I am still relatively new to the IP industry. That said, I think we as IP professionals can do more to build awareness for careers in IP. This is a really incredible, dynamic, and fulfilling field that many do not know exists. </p><p>People often share with me that they "kind of fell into IP." That’s great (and true for me, too!) but I wonder how many talented professionals we’re missing because they didn’t know about careers in IP. </p><p>I’ve made sharing awareness of our field a mini-mission of mine and I know many others are doing the same. Here’s the Evidence.</h1><p>When a patent application is filed with the USPTO, it’s assigned to an art unit and a patent examiner in that art unit based on the technology involved. </p><p>The USPTO “classifies” an application by assigning it codes to indicate the technological subject matter of the patent. Then an art unit and examiner are selected based on the codes. Only then does the examiner leverage their subject matter expertise to review the application, do a prior art search, and determine whether to grant a patent.</p><p>In the past, the assignment process was manual. One group of USPTO employees reviewed applications and assigned codes and another group assigned the application to an art unit and examiner based on the codes.</p><p>More recently, we believe that the USPTO has begun automating the assignment process using machine learning. </p><p>How do we know the USPTO is automating this process? We’ve verified it using our proprietary Art Unit Predictor.</p><h2>USPTO Automation? The Proof is in the Predictions.</h2><p>The <a href="https://www.patentbots.com/about-art-unit-predictor" target="_blank">Art Unit Predictor</a> by <a href="https://www.patentbots.com/" target="_blank">Patent Bots</a> reviews patent applications and predicts the art units to which they will be assigned. As patent practitioners, we can use this tool to revise our applications and steer them toward favorable art units.</p><p>Over the last two years, we’ve seen the Art Unit Predictor’s accuracy rate improve dramatically. </p><p>When the process was fully manual, human inconsistency impacted the assignment process. Two different USPTO employees could classify the same patent with two different codes. Even the same USPTO employee could classify the same patent differently depending on the day.</p><p>By contrast, machines are incredibly consistent. When machines classify applications, the outcome will always be the same. As the chart illustrates, our prediction accuracy has steadily increased from 80% in the first half of 2020 to over 82% in the second half of 2021. </p><p>During this period, the implementation of our Art Unit Predictor has not changed. The only change is the USPTO data used to train and test the Art Unit Predictor. </p><p>The USPTO has stated publicly that it is introducing more automation into the patent assignment process. </p><p>Our increased accuracy indicates that the USPTO has become more predictable. It provides third-party validation that, yes, the USPTO is replacing manual human processes with automation.</p><p>We expect our accuracy to continue increasing as the USPTO automates more of the process. When the process becomes fully automated, we may even see 100% accuracy from our Art Unit Predictor. </p><p>Predictability through automation is good for the patent system! Automation lowers the USPTO’s costs and speeds up processing. As you all know, Word automated numbering is annoying in that it never works how you want it to.</p><p>People with more courage than I do also use Word references to get Word to properly update claim dependencies, but most people waste more time than they save in trying to do this.</p><p><b>We now recommend that you do all your claim numbering manually, and let Patent Bots automate it for you!</b></p><p>We have two types of automated claim numbering that we'll now describe. For both, we recommend that you turn on Word track changes first so you can exactly what changes we make.</p>
<h2 style="text-align: left;">Claim Renumbering</h2>
<p>Our claim renumbering does two things:</p>
<ul style="text-align: left;"><li>Makes sure that all your claims are in numerical order.</li><li>Automatically updates your claim dependencies.</li></ul>
<p>The most important thing to remember, is that <b>your claim numbers must always be unique</b>.</p><p>Suppose you have the following claims:</p>

<p>This is a little different. We don't require that your claims have unique numbers, but we do require that each claim set is already numbered correctly.</p><p>Suppose you have the following claims:</p>

This includes the as-filed claims and the claims as amended at each office action response. Every document from the image file wrapper with a document code of CLM is included.</p><p>Here is how it works:</p><p></p><ol style="text-align: left;"><li>Go to the PatentPlex page for any patent <a href="https://www.patentbots.com/patentplex/patent/14/942,551">like this one</a>.</li><li>Click the View Diffs button to open the Claim Diff tool.</li><li>The first two columns of the Claim Diff page allow you to select the claims to view. <p>The Claim Diff tool is a great time saver for just about anyone working with patents. Here are a few examples:</p><p></p><ul style="text-align: left;"><li>Litigators working to invalidate a patent can see how claims changed between filing and grant.</li><li>Litigators can see how the claims changed with each office action response to formulate prosecution disclaimer arguments.</li><li>Prosecutors can review how claims have changed during prosecution to revise their strategy with the patent examiner.</li><li>Prosecutors can make better decisions when drafting claims for a child application by comparing the issued patent claims of other family members.</li></ul><p></p>
<p>In my 15 years of practicing as a patent attorney, I've wasted so much time copying and pasting claims into Word and then using the Word redline feature to see the differences between claims. Thankfully I will never have to do that again!</p><p>The Claim Diff tool is only available for issued patents and public applications, but we would like to extend it in the future to include non-public applications. <p>Suppose you have a claim like this:</p>

<p>For the claim summary, you need to rewrite this claim like this:</p>
<blockquote style="border: none; margin: 0px 0px 0px 40px; padding: 0px;"><p style="text-align: left;">In some aspects, the techniques described herein relate to a method for perpetual motion including magic.</p></blockquote>
<p>Not hard for a single short claim, but mind numbing when you have several pages of claims.</p>
<p>The reason for creating a claim summary section is to ensure that your patent application has literal support for the claims. In my practice, I'm careful to make sure that the detailed description section (which does not include the claim summary section) describes the invention using the same words and phrases of the claims, but the claim summary section provides a good backup.</p>
<p>Our Word add-in allows you to generate a claim summary within Word. Here is a screenshot:</p>
